II. Interpretations and Definitions
Interpretation
The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.
For the purposes of this Privacy Policy:
App refers to Lovibond® AquaLX®, the software program provided by the Company.
Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to Tintometer GmbH.
Device means any device that can access the Service such as a computer, a cell phone or a digital tablet.
Personal Data is any information that relates to an identified or identifiable individual.
Service refers to the App.
Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
III. Description of the AquaLX® App
The Lovibond® AquaLX® App is a database App that allows the reading and summarizing of measurement data from the instruments MD50, MD150, MD110, PM630, MD610, and MD640 in relation to a specific measurement location and date. The App is available for iOS and Android and can be downloaded from the respective App stores on mobile devices. Through the App, measurement data from instruments can be read and linked together (as mentioned above).
IV. Description and Scope of Data Collection
The App is provided free of charge. No personal data is collected, transmitted, or processed by us during the download or use of the App. Data required to set up a user account in the App or similar is stored solely in the App on the respective mobile device; only the user of that mobile device has access to it. The data is stored in the App’s database on the user’s mobile device and can be exported from there as a CSV file, for example, as an email attachment using the corresponding email App on the mobile device. We do not have access to this data or receive it through transmission; only the user of the mobile device has access. The App provides functionalities for documenting, storing, or deleting data by the user.

While using our App, it may have access to certain information with your prior consent to provide App functionalities.
Information about your location However, Tintometer GmbH does not have access to this information, which is only needed to link your transmitted data with your location stored on your mobile device. You can enable or disable access to this information at any time through your device's settings.
V. Processing of Personal App Data
No collection, processing, or use of personal data related to the provision and/or use of the aforementioned App by Tintometer GmbH takes place. We do not collect user data in connection with the App download, nor do we have access to the data stored in the App by customers or App users, unless such data is actively transmitted to Tintometer GmbH by the customer, e.g., in the case of inquiries or similar. This means that the customer or user of the App is solely responsible for the processing of data through the respective App in the sense of data protection law, insofar as personal data of natural persons is affected.
VI. Processing of Personal Data by App Store Providers
Tintometer GmbH cannot rule out that the respective App store providers (e.g., the App Store for iOS devices or Google Play for Android devices) collect and/or process personal and/or personally identifiable data during the App download. The respective App store provider is solely responsible for such data processing under data protection law; we have no access to these data, nor do we have any influence over them. For further information on how App store providers handle personal data, we kindly ask you to contact the respective App store provider directly; the required information should be available on the provider's site.
